BELINKED TERMS AND CONDITIONS

By accessing or using beLinked, you agree to these Terms and Conditions.

1. DEFINITIONS

“beLinked” refers to the digital business card platform and services
“beLinked Card” or “Card” refers to a digital business card created on the
platform
“You” or “User” refers to the account holder
“Content” refers to all information, data, and materials uploaded to the
platform

2. SERVICE DESCRIPTION

2.1 What We Provide
beLinked is a Software-as-a-Service (SaaS) platform that allows you to:
– Create and manage digital business cards
– Share your contact information digitally
– Manage cards for team members
– Customize card appearance and content

2.2 Service Availability
– We aim for 99% uptime but do not guarantee uninterrupted access
– Maintenance windows will be scheduled during off-peak hours when possible
– We are not liable for downtime due to circumstances beyond our control

3. ACCOUNT REGISTRATION AND RESPONSIBILITIES

3.1 Account Creation
– You must provide accurate, current information
– You are responsible for maintaining account security
– One person or entity per account
– You must be 18 years or older to create an account

3.2 Team Member Management
– As account creator, you are responsible for all cards under your account
– You must have permission from team members to create cards for them
– Team members’ personal information must be accurate and consensual

4. PUBLICLY VIEWABLE INFORMATION

⚠️ IMPORTANT: By the very nature of digital business cards, all information
you add to beLinked Cards is publicly viewable and shareable.

4.1 Public Nature of Content
– Digital business cards are designed to be shared and viewed by others
– Anyone with access to your beLinked Card can view all information on it
– Information may be indexed by search engines
– Shared links can be forwarded to anyone

4.2 Your Responsibility
You acknowledge and accept that:
– You are solely responsible for the information you provide
– You should only include information you are comfortable sharing publicly
– beLinked is not responsible for how others use your shared information
– You should not include sensitive personal information beyond standard
business contact details

5. ACCEPTABLE USE POLICY

5.1 Prohibited Content
You may NOT upload, share, or include:
– Illegal, harmful, threatening, or abusive content
– Pornographic, obscene, or sexually explicit material
– Hate speech, discrimination, or harassment
– False, misleading, or fraudulent information
– Malware, viruses, or malicious code
– Content that infringes intellectual property rights
– Spam or unsolicited commercial content

5.2 Prohibited Activities
You may NOT:
– Spam other beLinked users
– Use the service for illegal purposes
– Attempt to hack, disrupt, or damage the platform
– Scrape, harvest, or collect user data
– Resell access without authorization (unless you are an approved reseller)
– Create fake or impersonation cards without consent

5.3 Content Moderation
– We reserve the right to remove inappropriate content without notice
– We may suspend or terminate accounts violating these terms
– Repeat violations result in permanent ban

6. PRICING AND PAYMENT

6.1 Subscription Fees
– R60 per beLinked Card per month
– Volume discounts available for multiple cards
– Prices subject to change with 30 days notice

6.2 Payment Terms
– Billing is monthly on the anniversary of your signup date
– Payment must be made via approved payment methods
– Failed payments result in immediate service suspension
– You are responsible for all applicable taxes

6.3 No Free Trial
– beLinked does not currently offer free trials
– All subscriptions begin immediately upon payment

7. CANCELLATION AND REFUNDS

Refer to our separate Refund and Cancellation Policy for complete details.

Key points:
– 1 month notice required for cancellation
– Limited refund window (14 days)
– No pro-rated monthly refunds

8. RESELLERS AND AFFILIATES

8.1 Authorized Resellers
– beLinked may authorize third-party resellers
– Resellers set their own pricing and terms
– Purchases through resellers are subject to the reseller’s refund policy

8.2 Reseller Responsibilities
– Resellers are responsible for customer support and refunds
– beLinked provides technical support only
– Resellers must comply with these Terms and Conditions

9. INTELLECTUAL PROPERTY

9.1 beLinked’s Rights
– beLinked, its logo, and platform are our intellectual property
– You may not reproduce, modify, or distribute our platform
– All rights not expressly granted are reserved

9.2 Your Content
– You retain ownership of content you upload
– You grant beLinked a license to display and distribute your content as
necessary to provide the service
– You represent that you have rights to all content you upload

10. DATA AND PRIVACY

10.1 Data Collection
– We collect information necessary to provide the service
– See our Privacy Policy for details on data handling
– We comply with the Protection of Personal Information Act (POPIA)

10.2 Data Storage
– Your data is stored securely on our servers
– We implement industry-standard security measures
– We cannot guarantee absolute security

10.3 Data Retention
– Active accounts: data retained indefinitely
– After cancellation: data retained for 30 days then deleted
– You may request immediate deletion

11. LIMITATION OF LIABILITY

11.1 Service “As-Is”
– beLinked is provided “as is” without warranties
– We do not guarantee the service will meet your specific requirements
– We do not warrant error-free or uninterrupted operation

11.2 Limitation of Damages
To the maximum extent permitted by South African law:
– beLinked is not liable for indirect, incidental, or consequential damages
– Our total liability is limited to the amount you paid in the past 12 months
– We are not liable for:
– Loss of profits, data, or business opportunities
– Misuse of your publicly shared information by third parties
– Damages caused by your violation of these terms
– Service interruptions or data loss

11.3 Indemnification
You agree to indemnify beLinked against claims arising from:
– Your violation of these Terms
– Your uploaded content
– Your misuse of the service

12. TERMINATION

12.1 Termination by You
– Submit cancellation with 1 month notice as per our Refund Policy

12.2 Termination by beLinked
We may suspend or terminate your account immediately if:
– You violate these Terms
– You engage in fraudulent activity
– You fail to pay subscription fees
– Required by law

12.3 Effect of Termination
– Access to the service ends immediately
– No refunds for prepaid periods (except as per Refund Policy)
– Your data will be deleted after 30 days

13. MODIFICATIONS TO TERMS

– We may modify these Terms at any time
– Material changes will be notified 30 days in advance via email
– Continued use after changes constitutes acceptance
– If you disagree with changes, you must cancel your account

14. GOVERNING LAW AND DISPUTES

14.1 Governing Law
These Terms are governed by the laws of South Africa.

14.2 Dispute Resolution
– Contact us first to resolve disputes amicably
– If unresolved, disputes will be subject to South African courts
– Johannesburg courts have non-exclusive jurisdiction

15. MISCELLANEOUS

15.1 Entire Agreement
These Terms constitute the entire agreement between you and beLinked.

15.2 Severability
If any provision is found invalid, the remaining provisions remain in effect.

15.3 No Waiver
Failure to enforce any right does not constitute a waiver.

15.4 Assignment
You may not transfer your account without our written consent.
